Wood Stain in Mexico (Saltillo) floor? And possibly some legal advice?

I recently hired a contractor finishing floors stains and Mexican tile floors in my house. As he was putting the spot, I was surprised to see that it was using a flooring product, but a wood stain standard. He assured me that this was an acceptable and appropriate product use – since it had already begun and it was too late to turn back, who had complete work. Now, three months after our mosaic is terrible … has spots and scaly areas. The contractor is telling me that we have an extraordinary amount wear on floors and ultimately, the problem is ours. Suggested that plants bring the level they were on the completion of the work and after using rugs and carpets to protect the floor. I'm not at all satisfied with that answer and I am considering legal options at this time. Before you do, someone can tell me if with wood stain on a tile floor is custom? Does anyone have resources you can point me? Thanks!
