Can I get a fulltime non 1099 job with a T.I.N.?
I’m not illegally in this country and have been petitioned. I was assigned a TIN so that I can work my current job thats a 1099. I was offered a full time position that isn’t 1099 and am wondering if I’m allowed to take that position or do I have to wait.
P.S. this is the 3rd time I’ve asked this and can only seem to get answers from douchebags who assume I’m Mexican. To them, don’t waste your time answering because I’m not. Thanks to anyone else who has a real answer.
1. Even if you are in the country legally, it is illegal for you to work in the country if you are not a citizen, lawful permanent resident (green card holder), or a holder of certain types of visas. Someone with a tourist visa, someone who entered under the visa waiver program, and certain other categories of non-permanent residents are legally in the country, but are prohibited from working in the country. Anyone who can legally work in the U.S. is eligible for a Social Security Number. Since an “individual taxpayer identification number” (what you are calling a TIN) is issued only to a person who is not eligible for a Social Security Number, it is illegal for you to work in the U.S. at any job, including a 1099 job. When your petition is evaluated, you may be asked if you have worked in the U.S. Working in the U.S. in any capacity, 1099 or otherwise, can result in the petition being denied.
